1. Acceptance of Agreement
By accessing the domain viblyshufflespt.cyou or placing a reservation for any edition of the MossPod desktop micro-garden, you enter into a legally binding contract with Viblyshufflespt Biophilic Systems Ltd. (Company No. 14982041), registered in England and Wales. If you do not consent to all clauses set forth in this agreement, you must immediately terminate use of our platform.
2. Pre-Order Terms & Production Batches
MossPod hardware units are crafted using small-batch slip-cast ceramics and hand-blown fluted borosilicate domes. Production windows and dispatch schedules displayed during configuration are estimated delivery timeframes. We reserve the right to modify delivery dates if laboratory culturing of live bryophyte batches requires extended acclimation for plant health. You retain the right to cancel any unshipped pre-order reservation for a full 100% refund up until the moment your kit enters transit dispatch.
3. Living Botanical Specimen Guarantee ("Live Arrival Safe Guarantee")
Because our products feature living botanical organisms (Leucobryum glaucum, Fissidens nobilis, Ficus pumila), special terms apply:
- Live Arrival Guarantee: We guarantee your moss will arrive hydrated and in viable vegetative condition. If extreme courier delays cause specimen desiccation or mold prior to unboxing, submit high-resolution photos within 48 hours of delivery to [email protected] for a complimentary expedited flora replacement capsule.
- Distilled Water Care Requirement: The user explicitly acknowledges that tap water contains calcium, magnesium, and chlorine salts that degrade living bryophyte cell walls. Failure to use distilled, reverse-osmosis, or demineralized water as documented in our guides invalidates subsequent plant health replacement claims.
4. Hardware Warranty & Limitation of Liability
Each MossPod ceramic base, LED canopy fixture, and USB-C power block is covered by a limited manufacturer hardware warranty (2 years for Studio Edition; 5 years for Pro Atmosphere Edition) against electrical failures, diode degradation exceeding 10% lumen loss, or ceramic defects.
TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, VIBLYSHUFFLESPT BIOPHILIC SYSTEMS LTD. SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM ACCIDENTAL WATER SPILLAGE ON ELECTRONIC DESK HARDWARE, OVERFILLING OF THE RESERVOIR BEYOND THE 180ML INDICATOR LINE, OR UNATTENDED OPERATING HAZARDS.
5. Intellectual Property & WebGL Asset Rights
All trademarks, vector emblems, brand styling, photography, copy, 3D WebGL spatial model assets, shaders, and source code on this website are the proprietary intellectual property of Viblyshufflespt Biophilic Systems Ltd. Unauthorized reproduction, extraction of 3D geometry, or reverse engineering of our fluted condensation airflow patent design is strictly prohibited.
6. Governing Law & Dispute Resolution
These terms and any disputes relating to the purchase of MossPod units shall be governed by and construed in accordance with the laws of England and Wales. The courts of London, England shall hold exclusive jurisdiction over any claim arising under this agreement.
